What one HOA’s covenants say about gutters

The recorded covenants for the Green Mountain Phase 1 HOA say each owner must keep the lot and the improvements on it in good repair and “in a clean and attractive condition.” The maintenance the section lists includes care for “roofs, gutters, downspouts,” along with exterior building surfaces, walks and glass surfaces. A different section says roof downspouts must connect to the lot and common pipe drainage system, and that “Roof downspout splash blocks are not allowed.” Those covenants belong to Green Mountain Phase 1 alone.

The code’s design and improvement standards for land development say “All lots shall provide drainage for stormwater runoff from roof and footing drains to an approved drainage system.” Its chapter on geologically hazardous areas separately prohibits point discharges from roof drains onto or upstream from an erosion or landslide hazard area, with listed exceptions. Both passages are about how sites are built, and neither one mentions cleaning gutters.
