Stucco and brick in the Church Street overlay

The Town Code says the standards of the Church Street District “recognize the distinctive character of the original Vienna commercial district.” On top of that district sits the Church Street Vision Incentive Overlay, § 18-236, whose design features are “voluntarily proffered by the owner or developer, and accepted by the Town in return for the grant of bonus incentives,” and the Town Council declares that “the goals of this article are best achieved voluntarily.”

The overlay’s materials lines read: “Stucco may be used no nearer than two feet eight inches (2’8″) to the base of the building.” The building base, up to that height, “should be constructed of brick or stone with a water table,” and the lines add “EiFS, or any like material, may only be used above the first floor,” and “Vinyl siding may not be used below the second floor on any wall or surface visible from a public way.”

Those are design features offered in connection with development, construction or reconstruction in the Church Street District, and they say nothing about what any existing building is made of. The overlay’s text never mentions cleaning or washing.

Non-single-family buildings and the Board of Architectural Review

Chapter 4 of the Town Code makes all land zoned other than single-family detached residential an architectural control district. In those districts, § 4-8 says no structure, building or sign may be “erected, reconstructed, altered or restored” until the Board of Architectural Review approves the plans, “provided that the provisions of this chapter shall not apply to the regular maintenance of the same as opposed to the reconstruction, alteration or restoration.” The same section says repainting “which results in the complete change of color of the said structure, building or sign or a substantial portion thereof” is “an alteration and not regular maintenance.”

The Board’s own page describes its reach as “all non-single-family uses” in designated design review districts. The Code does not define “regular maintenance,” and the section does not list washing or cleaning either way, so this page does not say whether a soft wash counts as maintenance.
