A gutter line in the Town’s rain barrel instructions

The Town’s Stormwater Manual for Outdoor Living Areas covers “stormwater management solutions associated with up to 400 square feet of impervious surface from outdoor living areas.” It lists four options: a rain barrel, a French drain, conservation landscaping or a rain garden. For the first, it says rain barrels “are typically located at the bottom of downspouts to capture runoff from the roof.”

The manual’s maintenance list for owners who chose a rain barrel includes “Inspect to ensure any screens, gutters, and downspouts are free of leaves and debris.” It also says “Property owners are responsible for the proper operation and ongoing maintenance of all BMPs.” The manual attaches the inspection step to the rain barrel option and does not present it as a rule for every house’s gutters.

Downspouts and overflow in the same manual

For the conservation landscaping option, the manual says “All concentrated flows, including downspouts, must be dissipated using a pop-up emitter, gravel sump, or other form of erosion prevention.” Its general guidelines for these projects say to “Ensure channeled water or any discharged overflow is not directed toward building foundations or adjacent properties.” Those are design guidelines for projects under the manual, not a general downspout rule.

How the manual shows up in the Code

The Town Council’s agenda record lists item 22-3179, approval and intent to adopt text amendments on lot coverage, as passed on June 13, 2022, with the Stormwater Manual for Outdoor Living Areas as an attachment. Today’s § 18-213 lets some deck area go uncounted in lot coverage on conditions, and one condition reads: “Must provide for stormwater BMPs in accordance with the Stormwater Manual for Outdoor Living Areas and meet all criteria included in said manual.”

County and utility guidance on gutters and ladders

On a Fairfax County page, the Northern Virginia Soil and Water Conservation District says “Gutters should be cleaned free of debris at least once a year.” That is the District’s homeowner guidance for Fairfax County, not a Town rule.

Dominion Energy’s ladder safety page, which shows a 2020 publication date, lists cleaning gutters among the jobs people use ladders for and says to keep ladders “at least 10 feet from any power lines.”

Gutters in Windover Heights

The Windover Heights Historic District in northwest Vienna has its own review under § 18-840, and that section and § 18-237 never mention gutters. They apply to that district only.
