Whether your association can say no

Virginia law is specific on this. Under the state’s Property Owners’ Association Act, an association cannot prohibit an owner from installing a solar energy collection device on that owner’s property unless the recorded declaration for the association establishes the prohibition. An association can set reasonable restrictions on the size, place and manner of placement on individually owned property, and it can prohibit or restrict solar devices on common elements or common areas. The condominium act has a parallel section.

If you’re in the historic district

Inside the Old and Historic Alexandria District, installing or replacing a solar energy system requires Board of Architectural Review approval if it would be visible from the public right-of-way. That is a city requirement, separate from anything in an association’s declaration, and it applies within that district rather than citywide.
